Required Senior Expert To Develop The Competition - UNDP - Government of Kuwait

The Government of Kuwait has intensified its efforts to promote pro-competitive acts and promote the principles of good governance and fair trade, including transparency, accountability, participation, and equal opportunity and a competitive market and in 2007 the Kuwaiti government and the parliament approved the competition protection laws 10/2007, which stated the establishment of an independent authority to establish, monitor trade and regulate the market for any anti competition acts known here are the Competition Protection Authority (CPA).

Within this perspective, UNDP Kuwait has recently initiated its partnership with the Competition Protection Authority which is expected to lay the ground for a long-term partnership in the establishment, design and implementation of effective anti-competition and protection activities. The Project aims in particular at i) establishment of the CPA authority policy and procedures, ii) creation of an organizational chart, departments and job qualification for every position iii) supporting the market by facilitating there claims for any anti-competitive behaviors and the creation of a penalty structure. To this end the project is expected to contribute to the development of a common understanding of what is the role of the CPA activities and allow better inter-agency cooperation between the Capital Market Authority and the Ministry of Commerce and Industry (MOCI) and the market as a whole by introducing of standardized implementation mechanisms and tools, including administrative and procedural instructions, control requirements, monitoring and oversight systems.

To this end, the Project is expected to recruit an international or national expert to achieve the following outputs:

    Output 1: Organization chart, management structure of the authority and job qualification and description for all the positions/departments within the CPA.
    Output 2: Policy and procedure for administrative and procedural instructions, control requirements, monitoring and oversight systems and penalty structure.

Objectives and deliverables

General and specific objectives of the assignment are:
    To create the Policy and Procedures of the CPA based on 10/2007 law issued by the parliament and its amendments.
    To provide support and strategic advice for the implementation of CPA policy and procedures and organizational structure.
    To produce the required positions and the qualification for the CPA to perform at full capacity.
    To facilitate the acceptance of claims from companies that have been affected by anti-competitive acts and investigate them.
    To retrieve financial information from companies that have been accused of anti-competitive acts and issue reports based on claims.
    To plan the IT and security requirement for establishing a fully functional CPA.
    To produce an administrative and procedural instructions, control requirements, monitoring and oversight systems for the CPA.

Education:
    Advanced university degree in public administration, law, international law, and or international trade;

Experience:
    Preferable 15 years of professional experience in the fields relevant to anti-competitiveness, anti-dumping and anti-trust laws. minimum of 10 years of professional experience is required,
    Preferable 15 years of international experience, but a minimum of 5 years of international experience in the fields relevant to the international and/ or national Projects on anti-corruption is required.
    Specific experience in provision of technical assistance on implementation of national anti-competition/dumping/trust laws and strategies,
    Experience in anti-competition/dumping/trust processes in both continental Europe, North America, Asia, Middle East and Anglo-Saxon country contexts ,
    In-depth knowledge of different country practices on anti- competition/dumping/trust and of best practices,
    Experience in key expert positions in at least 2 international projects of similar scope, experience as team leader is an asset.
    Full computer literacy

The Key Expert shall support the implementation of UNDP & CPA interest in establishing the above objectives and over all bylaws. In that respect, the Key Expert will work closely with the project partner (CPA) and relevant stakeholders including MOCI and Capital Market Authority.

In specific terms the Key Expert will be responsible for the following:
    Provide strategic advice and technical inputs for proper implementation of the bylaws.
    Develop each department of the CPA and allocate their functions, tasks and documentation.
    Develop organizational structure with qualification of each position.
    Use law 10/2007 to stipulate the bylaws from and establish the policy and procedures.
    Review all the technical outputs (e.g. reports etc.) to be generated within the scope of the Project, and improve and/or ensure improvement of such reports in accordance with the expectations of the Projects partner CPA  and UNDP
    The Key Expert will report to the UNDP’s Program Manager (Private Sector Development).
    To provide best practice on how to apply and monitor competition laws and anti-competitive behaviors in other countries and in comparison to other authorities or similar organizations
    Plans to be drawn on how to train senior management and prepare the roles and activities in relevant competition issues.
    Determine IT and security needs for the CPA.
